SERVICE AGREEMENT
1. LadiesLinksForeGolf.com is a website owned and operated by LADIES LINKS FORE GOLF, LLC, a Florida Limited Liability Company, and no individual member of the Limited Liability Company is responsible for the information provided by others on this website. All references to LadiesLinksForeGolf.com in this Agreement shall mean LADIES LINKS FORE GOLF, LLC, a Florida Limited Liability Company. All information presented by LadiesLinksForeGolf.com is for education purposes only. The material is not intended to be a substitute for medical counseling. The site is intended to help you improve your golf game through golf performance, mental, and various fitness tips for golf. Before adhering to any of the information or recommendations presented throughout the LadiesLinksForeGolf.com web site, tournaments series and/or newsletters, please consult with your own physician or healthcare practitioner. LadiesLinksForeGolf.com reserves the right to refuse or cancel membership to any party for any reason, including medical conditions if LadiesLinksForeGolf.com receives notice of such condition. LadiesLinksForeGolf.com assumes no responsibility for inquiring into the medical condition of any subscriber.
2. GENERAL TERMS AND CONDITIONS: You agree to: (a) maintain all equipment necessary for your access to and use of LadiesLinksForeGolf.com; (b) maintain the security of your user identification, password and other confidential information relating to your LadiesLinksForeGolf.com account; (c) be responsible for all charges resulting from use of your LadiesLinksForeGolf.com account, including unauthorized use prior to your notifying LadiesLinksForeGolf.com of such use and taking steps to prevent its further occurrence by changing your password; and (d) updating your personal information, including e-mail address. By joining www.ladieslinksforegolf.com you will automatically receive our complimentary newsletter. If at any time you wish to unsubscribe to our newsletter simply click on the unsubscribe option located at the bottom of our newsletter.
3. MEMBERSHIP TERM: The membership period is 12 months or 1 year from the initial date of subscription, payable one year in advance. Unless specified otherwise on this web site, after the Initial membership term, each membership is renewed every year and members are financially responsible for all associated renewal fees until notice of cancellation is received by LadiesLinksForeGolf.com. LadiesLinksForeGolf.com reserves the right to change its fee structure at any time, including to increase or decrease fees or add any new fees or charges at any time, and LadiesLinksForeGolf.com shall have the right to charge your authorized credit card for each renewal of membership on the anniversary date of your initial membership, each year, unless notification of your cancellation is received by LadiesLinksForeGolf.com prior to that date. Once a new subscription has been received or an existing subscription is renewed, LadiesLinksForeGolf.com will not change the subscription fee applicable to any period for which you have already been subscribed.
4.CANCELLATION BY YOU.
You may terminate your account, effective at the end of the period for which you have subscribed to the Site, by sending an e-mail to: carol.shea@ladieslinksforegolf.com. You will receive a confirmation e-mail upon receipt. You are responsible for all membership and other fees and charges incurred by you or by any user of your account up to the time the account is deactivated.
A member may cancel as follows:
By email: send an email to carol.shea@ladieslinksforegolf.com indicating within the body of the message your intent to cancel. Be sure to include your first and last name and user name. Please note that LadiesLinksForeGolf.com will not accept or open email communications with attachments.

5. CANCELLATION BY LADIESLINKSFOREGOLF.COM.
You agree that LadiesLinksForeGolf.com, in its sole discretion, may terminate your password, your account and/or your use of the Site, and remove and discard any Material within the Site, at any time and for any reason. You agree that any termination of your access to the Site under any provision of the these terms of service may be effected without prior notice, and acknowledge and agree that LadiesLinksForeGolf.com may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Site. Further, you agree that LadiesLinksForeGolf.com shall not be liable to you or any third-party for any termination of your access to the Site; provided that LadiesLinksForeGolf.com refunds to you a pro rata portion of the membership fees paid by you for periods after the effective date of the termination . Such refund may be made by crediting your authorized credit card with the refund amount or mailing you a check for the refund amount.
6. CHANGES TO SERVICE. LadiesLinksForeGolf.com may change, modify, add, suspend or discontinue, temporarily or permanently, any aspect of the Site at any time, including the availability of any feature, database, or content, with or without notice to you. LadiesLinksForeGolf.com may also impose limits on certain features and services or restrict your access to part or all of the Site without notice to you. You agree that LadiesLinksForeGolf.com shall not be liable to you or to any third party for any such change, modification, addition, suspension, discontinuance, limitation or restriction.
7. WAIVER, RELEASE AND LIMITATION OF LIABILITY: You agree that neither Ladies Links Fore Golf, LLC, nor its affiliates, subsidiaries, officers, directors, employees, agents, consultants or information providers or suppliers, shall have any liability to you under any theory of liability or indemnity in connection with your use of LadiesLinksForeGolf.com. You hereby release and forever waive any and all claims you may have against Ladies Links Fore Golf, LLC, its members, officers, directors, employees, agents, consultants, information providers or suppliers for losses or damages you sustain in connection with your use of LadiesLinksForeGolf.com.
8. LIMITED LIABILITY: Notwithstanding the foregoing paragraph, the total liability of Ladies Links Fore Golf, LLC and its officers, directors, employees, agents, consultants, information providers and suppliers, if any, for losses or damages shall not exceed the fees paid by you for the particular information or service provided. All other damages, direct or indirect, special, incidental, consequential or punitive arising from any use of the information or other parts of LadiesLinksForeGolf.com are hereby excluded even if Ladies Links Fore Golf, LLC or its officers, directors, employees, agents, consultants, information providers or suppliers have been advised of the possibility of such damages. Void where prohibited by law.
9. NOTICE: Ladies Links Fore Golf, LLC may deliver notice to you under this Agreement by means of electronic mail, a general notice on LadiesLinksForeGolf.com or by written communication delivered by first class U. S. mail to your address on record in the Site's account information. You may give notice to Ladies Links Fore Golf, LLC at any time via electronic mail to carol.shea@ladieslinksforegolf.com or by letter delivered by first class postage prepaid U. S. mail or overnight courier to the following address:

COPYRIGHT AND TRADEMARK PROTECTION: The name, Ladies Links Fore Golf and all Logos and trademarks used on the website are the exclusive property of LADIES LINKS FORE GOLF, LLC and may not be reprinted or used in any way other than for the private viewing of the subscriber. Likewise, all videos, audio recordings, text, and other information included on the website are the exclusive property of LADIES LINKS FORE GOLF, LLC and are intended solely for the private use of the Subscriber. No reproduction, copy, recording, or other electronic transmission of the materials included on this website may be given or sold to others without the express written permission of Ladies Links Fore Golf, LLC.
11. NO WARRANTIES FOR PRODUCTS ADVERTISED OR LINKED ON WEBSITE: Ladies Links Fore Golf, LLC makes no warranties whatsoever regarding products or services advertised on linked on LadiesLinksForeGolf.com. Specifically, there are no warranties of merchantability or fitness for purpose, express or implied, for the products and services advertised, linked, or otherwise recommended on LadiesLinksForeGolf.com. Ladies Links Fore Golf, LLC shall have no liability for damages caused by products advertised on or linked from LadiesLinksForeGolf.com. LadiesLinksForeGolf.com shall not be deemed a Seller of any products advertised or linked on the website, and the subscriber shall look solely to the manufacturer of any such product for damages or breaches of warranty, express or implied. |
